One of the more controversial sections of the UDO is section 2.4 about other housing options. The proposed regulations will give property owners the option to create either an apartment unit within or a backyard cottage behind a detached house (single-family dwelling unit). The current regulations permit an apartment unit only and the primary living area must be owner-occupied. Owner-occupancy is not required in the proposed regulations. A recent court case ruled that the owner-occupancy requirement is discriminatory.
