Subject: Zoning Protest Petitions, Action Alert Update
Dear Neighbors:
Yesterday I told you that instead of voting on S. B. 112, the bill that the NC House of Representatives amended to abolish zoning protest petitions, the North Carolina Senate has created its own version of the bill by amending H. B. 74. This bill does not tamper with protest petitions. This morning the senate gave its final approval to its version of the bill . It will now go to the house.
Both versions of the bill contain a long list of provisions affecting the way state and local government agencies regulate everything from the environment to bed and breakfast businesses. There a differences and the one of the big ones is the protest petition provision. I can only think that the hue and cry raised by neighborhood advocates since last week has made a difference. The question now is which version of the regulatory reform bill will pass and, when it passes, what will it say about zoning protest petitions?
The right of a neighboring property owner to protest the proposed rezoning of an adjacent property is as old as zoning itself in North Carolina. The 1923 enabling legislation that first authorized NC cities to regulate land use by zoning expressly permitted a protest petition. The petition right is part of the concept of zoning, the original balance of competing interests which is built into the zoning process. From the beginning, when neighbors filed a valid petition, the rezoning could pass with only a supermajority vote of the city council. Today, a protest petition is valid if it signed by the owners of 5% of the band of property 100 feet wide surrounding the property to be rezoned. When a valid petition is filed, the rezoning can be approved only with a ¾ majority vote of the city council. While 5% doesn’t sound like much, it is actually a very high bar and the result is that only a few valid petitions are filed. Fewer still
actually result in the defeat of the proposed rezoning. It is the existence of the petition right in the first place that causes developers to be good neighbors. When the necessary threshold of neighbors actually file a valid petition, it is a signal to the city council and the whole community that the proposed rezoning is controversial and deserves special scrutiny. If the protest petition right is taken away, the whole zoning process will be out-of-balance. Ordinary people, the very people whose interests in their homes are meant to be protected by zoning rules, will lose their only leverage in a process that is often stacked against them. Modern zoning regulations are complicated and ordinary people who cannot afford attorneys and land planners are alienated from the process. The last thing the legislature should consider is a move that will only increase this alienation.
So, this weekend, let’s redouble our efforts to let our legislators in both the house and the senate know how important the preservation of zoning protest petitions is to us. Again, here are the three steps you can take:
1) E-mail all the members of the General Assembly from your community, both in the Senate and the House. Tell them to save your right to file a zoning protest petition in whatever version of the regulatory reform bill they may ultimately pass. Please do not say “Vote against S. B. 112” or “Vote for H. B. 74.” Both bills are loaded with provisions that legislators and citizens feel passionate about. We don’t want to get tangled up in the larger debate. Also, because the situation is fluid, we don’t know which bill will start moving or what it may ultimately say. Our message should be “Don’t tamper with the right of an ordinary citizen to file a zoning protest petition.” You can find your senators’ and representatives’ e-mail addresses at www.ncleg.net.
2) Share this message with other neighborhood advocates in your community. Post it on your neighborhood listserves and facebook pages. Messages form ordinary people at home carry a great deal of weight with elected officials in Raleigh. (That is as it should be, right?)
3) E-mail Governor McCrory. He was Mayor of Charlotte and has a wealth of knowledge about the balance of rights that is built into the zoning process. While he probably will not veto the final regulatory reform bill, he should know about our issue. He may use his influence to remove the controversial protest petition provisions from the legislation before it reaches his desk. You can write the governor at www.governor.state.nc.us.

Free Carousel Rides on Independence Day
For the last 76 years, the historic No. 2, Special Three Abreast Allan Herschell Carousel has called John Chavis Memorial Park home. The carousel, formerly used for traveling shows, was purchased for the park in 1937 for $4,000 and was opened to the public on July 4, 1937.
To mark the Carousel's 76th Anniversary the Parks and Recreation Department is offering free carousel rides all day long on July 4. Come ride the carousel as many times as you dare, then come back to watch the fireworks!

Hey neighbors,
I hope everyone is enjoying the warm weather. I thought I'd
send out an update to the group since it has been a little
while since my last one. I apologize for the delay since my last communication.
In the meantime I married my lovely fiancé, went on my honeymoon, had a death
in the family and went on several business trips around the country. So, I've
been a little busy even if my communications to the group didn't reflect that.
First things first, our next Community Watch meeting will be
next Wednesday, June 26 at 7:00 PM. We're going to pick up on the suggestion
from our last meeting to meet outside to enjoy the nice weather. We'll meet at
the Culpepper Park. Bring a chair and bug spray. If you want to bring
refreshments, please do. If the weather is foul, the rain date will be
Thursday, June 27 at 7:00 PM. If we get rained out that day as well, I'll send
another email to the group with another date.
Next, I've signed up our group to participate in the National
Night Out event on August 6, 2013, like we discussed in our last meeting. I'll
bring information on this event to the meeting on the 26th, but the website
where you can read about the event is www.natw.org. We'll brainstorm ideas for
activities as part of the National Night Out at the next meeting.
The traffic calming effort on King Charles has taken its
next step forward. White paint markings have been placed on the street and curb
to delineate the location of traffic calming treatment and signs. Please take a
chance to look at them when you have a chance. Comments can be sent to

Lastly, did you all do your homework from the last meeting?
Your homework was to go out and look at your street lights to note any that are
burned out, faulty or find locations where a light should be added. Did you all

evenings. Take a friend or neighbor if you prefer not to walk alone after dark.
Please bring your homework to the next meeting. Be sure to write down the pole
numbers of associated with any issues you may find as we'll need to pass along this information to Duke Energy for review. Thanks again to Emrys for

The new Development Fee Schedule is now available and will become effective July 1, 2013.
City Council approved the increase of Public Utilities fees (Code of Ordinances - Part 8). These increases will become effective July 1, 2013.
In accordance with TC 1-07, development related fees were increased by 2.10% and will become effective July 4, 2013. The new minimum permit fee is $80.00.
In addition to these, facility fees also increased by 2.62% in accordance with TC 5-08 and will become effective July 4, 2013.

A win for transit - NC Senate Passes Transportation Overhaul
The NC Senate voted 44-2 on Monday to give final approved to the Strategic Transportation InvestmentsBill 817, which included language WakeUP asked for to ensure future transit projects have fair access to state funding. Thanks to Wake Senator Josh Stein and others for speaking up for this change! This is the largest overhaul in how state transportation funds are spent around the state in 24 years. The approved Transportation Money Formula includes public transit in the "regional" funding tier. The bill is expected to receive final House approval soon.

Raleigh City Council approves transportation bond for October ballot
The Raleigh City Council voted Tuesday in favor of putting a $75 million transportation bond on the ballot in October. This is the largest proposed bond referendum in Raleigh's history and would fund about 15 road projects as well as some sidewalk and traffic calming measures. The details of the proposed bond including which project will be funded will be discussed at the Council's June 24th meeting. Transit improvements may be part of the initiative.
Morrisville's Planning Ahead for Transit!
Morrisville's Town Council could approve a plan next week for the new McCrimmon Transit Small Area Plan. This plan includes a mixed-use development and the blueprint for a future rail station. Thank you, Morrisville, for being a transit leader in Wake County!
